1. Acceptance of Terms

By creating an account, downloading, or using Nobiru, you agree to these terms. If you don't agree, please don't use the app.

2. Eligibility

You must be at least 16 years old to use Nobiru. The app is not designed for, and is not permitted to be used by, anyone under 16. If we learn that someone under 16 has created an account, we'll remove it.

3. The Service

Nobiru is a routine guidance app that adapts to your time and energy. It helps you build and maintain daily routines based on the principle that consistency beats intensity.

4. AI-Generated Content

Nobiru uses third-party AI services, including Google Gemini and OpenAI, to generate routine suggestions and voice guidance. AI output can be inaccurate, incomplete, or unsuitable for your situation.

5. WHOOP Integration

Connecting WHOOP is optional. If you choose to connect, you grant Nobiru read access to your recovery, sleep, and strain data. We use this data solely to personalize your routines.

• WHOOP data is not shared with third parties
• You can disconnect WHOOP at any time in Nobiru settings or your WHOOP account
• Disconnecting removes access immediately and your stored WHOOP data is deleted

6. User Accounts

You're responsible for keeping your login credentials secure and for any activity under your account. If you think someone else has accessed your account, contact us at [email protected] right away.

7. Acceptable Use

When using Nobiru, please don't:

• Abuse, harass, or harm other users or our team
• Reverse engineer, decompile, or attempt to extract source code
• Use bots, scrapers, or other automated tools against the service
• Attempt to gain unauthorized access to accounts, systems, or data
• Use Nobiru in any way that violates applicable laws or regulations

8. Subscriptions and Payments

Nobiru is currently free to use. Paid plans may be introduced in the future; if so, terms specific to those plans (including billing, renewals, and refunds) will be added here. Any paid features offered through the App Store, Play Store, or a web payment processor will also be subject to those platforms' policies.

9. Termination

You can delete your account at any time from within the app's Settings, or by visiting nobiru.ai/delete-account.

We may suspend or terminate accounts that violate these terms, or that pose a risk to other users or the service. Where reasonable, we'll let you know before taking action.

10. No Warranty and Limitation of Liability

Nobiru is provided "as is" and "as available". We do our best to keep things working well, but we don't guarantee the service will always be uninterrupted, error-free, or perfectly suited to your needs.

To the extent permitted by law, Nobiru Pty Ltd is not liable for indirect, incidental, or consequential damages arising from your use of the app — including lost data, lost time, or any health, fitness, or wellbeing outcomes. Nothing in these terms excludes rights you may have under Australian Consumer Law that cannot be waived.

11. Changes to These Terms

We may update these terms from time to time. When we do, we'll post the updated version here with a new effective date. Continued use of Nobiru after changes means you accept the updated terms.

12. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Australia. Nobiru is operated by Nobiru Pty Ltd (ACN 694 045 415).
